Terms of Service

These Terms govern use of the ErsatzReality storefront and any purchase made through it. By using the storefront or placing an order, you agree to these Terms and the policies presented at checkout. If you do not agree, do not place an order.

1. Product status

Only products expressly presented as available for purchase are offered for sale. A card marked “Coming Soon” or “In Production” is informational only. It is not an offer, preorder, reservation, delivery promise, or guarantee that the product will be released.

2. Product information

We work to describe products, formats, compatibility requirements, included rights, and any limitations accurately. Colors and appearance may vary by screen. Product-specific terms shown before purchase form part of these Terms.

3. Orders, prices, and payment

Displaying a product does not by itself mean an order has been accepted. An order is accepted only when the store issues an order confirmation after any required payment authorization. Where permitted by law, we may decline or cancel an order affected by an obvious pricing error, suspected fraud, unauthorized activity, or inability to supply the described product. Any approved refund will be handled under the Refund Policy and applicable law. These Terms do not claim that any particular payment method is active.

4. Digital products and licenses

Unless a product page expressly says otherwise, purchasing digital content grants the purchaser a limited, personal, non-exclusive, non-transferable license to use that content for its stated purpose. A purchase does not transfer copyright, trademark, character, world, artwork, source-file, or other intellectual-property ownership.

5. Access, delivery, and re-access

The delivery method, timing, file format, access period, download limit, and re-access rights are only those expressly stated on the product page or order confirmation. Re-access is not included unless it is expressly offered. Customers are responsible for providing a usable email address and meeting stated device or software requirements.

6. Personalized and custom work

A customer requesting personalized or custom work must provide accurate instructions and must have the rights and permissions needed for any names, images, likenesses, text, or other materials supplied. The store may refuse material that is unlawful, infringing, deceptive, abusive, unsafe, or outside the agreed scope. Product-specific scope, revision, cancellation, and approval terms control where stated.

7. Acceptable use

Customers may not redistribute, resell, sublicense, publish, scrape, copy, or commercially exploit protected content except where the product license expressly permits it. Customers may not bypass access controls, misuse download links, interfere with the storefront, introduce malicious code, or use the storefront for fraud or unlawful activity.

8. Intellectual property

The storefront, THYLORA and ErsatzReality materials, original stories, worlds, characters, artwork, layouts, and related content remain owned by their respective rights holders. No implied license is granted beyond the express terms of the purchased product.

9. Third-party services

The storefront may rely on third-party services for hosting, checkout, payment processing, communications, or content access. Those services may have their own terms and privacy practices. The store does not promise that an unsupported third-party service will remain continuously available.

10. Disclaimers and limitation

To the extent permitted by applicable law, the storefront and its content are provided without warranties beyond those expressly stated. Nothing in these Terms excludes or limits liability, warranties, consumer rights, or remedies that cannot legally be excluded or limited.

11. Changes

We may update these Terms prospectively. The effective date will identify the current version. Terms presented at the time of purchase will continue to govern that purchase except where applicable law requires otherwise.
